These Terms of Service (“Terms”) are a binding agreement between you and Parkspot.ai (“Parkspot”, “we”, “us”). They cover the parkspot.ai website, the Parkspot mobile app, and the Parkspot platform for cities and fleets (collectively, the “Service”).
Sections 6 (Driver Responsibility), 7 (AI and Data Limitations), and 13 (Limitation of Liability)are important — they allocate responsibility between us and you. Read them carefully.
1. Acceptance and scope
By creating an account, joining the waitlist, or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
If you’re using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” in these Terms means the organization.
2. Eligibility
You must be at least 18 years oldand able to enter a binding agreement under the law of your jurisdiction. The Service is not available to users we’re prohibited from serving under sanctions or export-control law.
3. The Service
The Service shows you, in near real time, where parking spots appear to be open on streets covered by publicly available city camera feeds. Parkspot does not own the cameras, the streets, the parking spots, or the regulations that apply to them. We provide a viewfinder. You drive the car.
The Service is currently being launched. Features may change, break, or be removed with limited notice. Availability and accuracy are not guaranteed at launch-grade levels during the rollout.
4. Your account
- Provide accurate information and keep it current.
- Keep your credentials confidential. You’re responsible for activity under your account.
- Notify us promptly of unauthorized access at legal@parkspot.ai.
- Comply with applicable law and with these Terms.
5. Subscriptions, billing, and refunds
5.1 Free tier and Parkspot Pro
The Service has a free tier (with monthly limits) and a paid tier (Parkspot Pro). Pricing is shown in the app and at parkspot.ai/pricing at the time of purchase.
5.2 Auto-renewal
Paid subscriptions renew automatically at the end of each billing cycle until you cancel. You can cancel any time in the app or with the platform you subscribed through (Apple, Google, Paddle).
5.3 Refunds
Refunds are handled by the platform you subscribed through, in line with that platform’s rules. We don’t issue refunds for partial billing periods, unused time, or features you chose not to use, except where required by law (for example, EU consumer rights of withdrawal where they apply).
5.4 Price and feature changes
We may change prices, plan features, or limits. Changes take effect at the start of your next billing cycle. We’ll notify you at least 30 daysbefore a price increase that affects an active paid subscription. If you don’t accept the change, you can cancel before it takes effect.
5.5 Founding-member pricing
If you joined under a founding-member or early-access price, that price is locked for the period stated in the offer at the time you signed up. We honor the locked price as long as your subscription is continuous.
6. Driver responsibility
This section is important. It allocates responsibility for every parking decision you make. Read it carefully.
6.1 You are the driver. You decide.
Parkspot suggests where parking might be available based on what cameras can see. The app does not park your car, drive your car, see what your eyes see, or know what you know. Every parking decision is yours.
6.2 Always verify on the street
Before parking, you must check, with your own eyes:
- The actual location of the spot;
- All signs and pavement markings (no-parking, no-standing, fire hydrant, bus stop, loading zone, sweeping schedule, commercial-only, residential-permit);
- Distance to fire hydrants, crosswalks, intersections, driveways, and bicycle lanes as required by local law;
- Obstructions, hazards, vehicles, and pedestrians around the spot;
- The legality and safety of the spot at the time you intend to park.
A spot suggested by Parkspot may have become occupied, illegal, blocked, or unsafe between the moment a frame was processed and the moment you arrive. You are responsible for verifying current conditions yourself.
6.3 You are responsible for tickets, towing, damage, and accidents
You are solely responsible for any parking ticket, civil penalty, towing fee, vehicle damage, property damage, personal injury, traffic violation, or accident that occurs because of, in connection with, or while using the Service. Parkspot is not your driving instructor, your traffic engineer, your insurer, or your lawyer.
6.4 No safety-critical reliance
Do not interact with the Service while driving in a way that distracts you. Pull over before checking the app. Do not use the Service for any safety-critical purpose. The Service is informational only.
6.5 Obey the law
You must obey all applicable traffic, parking, and motor-vehicle laws regardless of what the Service shows. If a sign, an officer, or a regulation conflicts with the Service, the sign, the officer, and the regulation win — every time.
7. AI and data limitations
You acknowledge and agree that:
- Camera detections can be wrong.Computer vision systems make mistakes. A spot we show as “open” may be occupied; a spot we don’t show may actually be open; signs and markings may not be visible from the camera angle.
- Conditions change. Spots open and close in seconds. Camera latency, processing latency, and your travel time mean what you see is at best a recent picture, never the live street.
- Coverage is partial. We cover only blocks where cameras exist and where signal quality is adequate. Most streets are not covered.
- Camera feeds are third-party. The cameras we read are operated by their owners. Outages, changes in feed availability, takedowns, and policy changes are outside our control.
- Estimates are not guarantees. Time saved, fuel saved, and ticket-risk indicators are estimates based on aggregate patterns. They are not predictions of your individual outcome.
- Not professional advice. Nothing in the Service is legal, financial, insurance, or regulatory advice.
8. Acceptable use
Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms. The AUP defines prohibited uses (including illegal activity, harassment, scraping, training competing models, surveillance, and circumvention), camera-feed integrity rules, and enforcement and appeal procedures. A violation of the AUP is a violation of these Terms.
9. Your data and content
You own your content. If you submit feedback, reports, photos, or notes through the Service, you keep ownership of them.
You grant Parkspot a worldwide, royalty-free license to host, copy, process, transmit, and display your content only to the extent necessary to operate the Service for you, prevent abuse, and comply with the law. The license ends when you delete the content or close your account, subject to short retention windows for backups described in our Privacy Policy.
If you submit ideas, suggestions, or feature requests, we can use them to improve the Service without compensation. This does not cover any confidential personal data that may appear in the message itself — that remains protected under our Privacy Policy.
10. Intellectual property
Parkspot owns the Service — the software, the user interface, the brand, the documentation, the proprietary models, and all related rights. These Terms grant you only a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Nothing in these Terms transfers any Parkspot intellectual property to you.
11. Beta, pre-alpha, and experimental features
Some features are clearly marked as beta, pre-alpha, preview, or experimental. They may be unstable, contain bugs, change without notice, lose your data, be removed, or be unavailable for extended periods. They are provided without any warranty. Use them at your own risk.
12. Disclaimer of warranties (AS-IS)
TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND — EXPRESS OR IMPLIED — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR QUIET ENJOYMENT.
We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time; that camera feeds will be available, accurate, or current; that any specific spot will be open when you arrive; that you will save any specific amount of time, fuel, or money; that you will avoid any parking ticket, towing event, or vehicle damage; or that you will not get into an accident.
13. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, PARKSPOT’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) USD 50 OR (B) THE FEES YOU PAID TO PARKSPOT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
TO THE FULLEST EXTENT ALLOWED BY LAW, PARKSPOT IS NOT LIABLEFOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COSTS OF SUBSTITUTE SERVICES, PARKING TICKETS, TOWING FEES, VEHICLE DAMAGE, PROPERTY DAMAGE, PERSONAL INJURY, OR ACCIDENTS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
Some jurisdictions don’t allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for statutory consumer rights that cannot be waived.
14. Indemnity
You agree to defend, indemnify, and hold harmless Parkspot and its officers, directors, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
- Your use or misuse of the Service;
- Your violation of these Terms or any applicable law;
- Any parking ticket, towing fee, vehicle damage, property damage, personal injury, accident, or traffic violation involving you;
- Your infringement of any third-party right (including intellectual property and privacy rights).
This indemnity is reduced to the extent the claim results from our gross negligence, willful misconduct, or material breach of these Terms.
15. Suspension and termination
You can stop using the Service at any time and close your account in the app or by emailing support@parkspot.ai.
We may suspend, restrict, or terminate your access if we reasonably believe you have materially breached these Terms or our acceptable-use rules; if we are legally required to; if your use creates risk for us, the Service, or other users; or if we retire the Service. Where the law requires it, we will give you notice and an opportunity to cure.
On termination, your license to use the Service ends; we delete your data per our Privacy Policy retention schedule; provisions that by their nature should survive (sections 6 (Driver Responsibility), 9 (Your data and content), 10 (IP), 12 (AS-IS), 13 (Liability), 14 (Indemnity), 18 (Disputes), and 19 (Miscellaneous)) survive termination.
16. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days’notice by email (if we have one) and by a notice on the Service. The “Effective” date at the top of this page reflects the current version. Continued use after the effective date is acceptance of the updated Terms.
17. Force majeure
Neither party is liable for delays or failures caused by events outside reasonable control — infrastructure or platform outages, third-party camera-feed unavailability, acts of God, natural events, epidemics, war, terrorism, civil unrest, government action, internet or power failures, or labor disruption.
18. Dispute resolution and governing law
We’d rather fix problems together than argue. If you have a dispute with us, please email legal@parkspot.ai first and we will try in good faith to resolve it within 30 days.
If informal resolution fails, disputes are resolved in the courts with jurisdiction over the place where Parkspot is established. These Terms are governed by the laws of that jurisdiction, without regard to its conflict-of-laws rules. Nothing in this section removes any right you have as a consumer in your home jurisdiction that cannot be waived.
19. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the complete agreement between you and us about the Service, replacing any earlier agreement.
- Severability. If a provision is unenforceable, the rest remains in force, and the unenforceable part is reformed to the minimum extent needed to make it enforceable.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets.
- No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- Third-party beneficiaries. There are no third-party beneficiaries to these Terms.
- Notices. We may give notice through the Service, by email, or by a banner on the website. Notices to us must be sent to legal@parkspot.ai.
